Accepting these terms

By creating an account, using HypeLap, or sending a cheer, you agree to these Terms. If you do not agree, do not use HypeLap. You must be at least 13 years old. If you are under 18 you need a parent or guardian's permission, and they agree to these Terms for you.

Run safely

• Stay aware of traffic, other runners and your surroundings. Follow the rules and instructions of your race and local laws.
• Do not use your phone in a way that is unsafe while running. Cheers can play in your earbuds: keep the volume low enough to hear traffic, race officials and emergency vehicles, and use the mute controls whenever you need to.
• Location tracking is not an emergency service. Do not rely on HypeLap to find you or call for help. In an emergency, call your local emergency number.
• You are responsible for your own health, fitness and decisions.

Your account

Runners sign in with Apple. Keep your device and Apple ID secure, and give us accurate information. You are responsible for activity on your account. Watching a runner and sending cheers does not need an account. You can delete your account at any time (see Delete your account).

HypeLap Pro and subscriptions

Watching and cheering as a friend is free. Runners use HypeLap Pro, which is sold as an auto-renewing subscription or a single-race pass through the App Store. The price and length of each option are shown in the app before you buy. At launch we expect: yearly $39.99 and monthly $5.99 (the yearly plan may include a 7-day free trial for new subscribers), and a single-race pass $2.99. Prices may change and can differ by country or taxes; the price you see at purchase is the price you pay.

• Payment is charged to your Apple ID account when you confirm your purchase, or when your free trial ends.
• Auto-renewal: subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Free trials: if you do not cancel at least 24 hours before the trial ends, you will be charged. Any unused part of a free trial is forfeited when you buy a subscription.
• Manage or cancel in your device's Settings, then your name, then Subscriptions (or at apps.apple.com/account/subscriptions). Deleting the app or your HypeLap account does not cancel a subscription.
• Refunds are handled by Apple. Request one at reportaproblem.apple.com.
• Restore purchases from the paywall or settings in the app if you reinstall or change devices.
• The single-race pass is a one-time purchase for one race and is not refundable by us except where the law requires.

Content you share

You may send sound cheers, typed messages and voice notes, and upload a name and a profile photo (“Your Content”). You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to store, process, transmit and display it as needed to run HypeLap: to deliver it to the runner you send it to, show it in their race recap, review reports, and keep the service safe. You promise you have the right to share it and that it follows these Terms and the Community Guidelines.

There is no tolerance for objectionable content or abusive users. Runners can mute or block any fan, and anyone can report a message, voice note or user. We review reports promptly, aim to act within 24 hours, remove content that breaks the rules, and suspend or ban repeat or serious offenders.

Rules of conduct

Do not use HypeLap to:

• harass, threaten, bully, stalk or shame anyone, or send hateful, sexual, violent or otherwise abusive content;
• impersonate anyone, or mislead people about who you are;
• spam, flood a runner with cheers, or send recordings that are very loud or designed to startle or distract;
• share someone else's watch link, location or personal information without their permission;
• break the law, break the rules of a race, or cheat in rankings (for example by faking location);
• scrape, reverse engineer, overload or attack HypeLap, or try to access other people's accounts or data;
• use HypeLap for any commercial purpose without our written permission.

Watch links and privacy

A watch link lets anyone who has it see your rank, distance, pace and progress until the link closes (when your race ends, or after at most 24 hours from the scheduled start, or when you turn it off). Share it only with people you want watching. We are not responsible for what people do with a link you share. See the Privacy Policy for what we collect and how we use it.

Our license to you

We give you a personal, limited, revocable, non-transferable license to use the HypeLap apps on Apple devices you own or control, as allowed by the App Store rules, and to use the website. HypeLap, its software, design, characters, sounds and brand belong to us and our licensors. You may not copy, modify, sell or create derivative works from them. Our characters are original to HypeLap.

Accuracy and availability

GPS, signal, battery and the Apple Watch vary, so distance, pace, times and rankings can be wrong, delayed or missing. HypeLap is not an official timing system and does not replace a race's official results. We work to keep the service running but may change, pause or discontinue features, and we do not guarantee that it will always be available or error-free.

Third-party services

HypeLap works with services we do not control, including Apple (sign-in, notifications, Health, the App Store and your device), your mobile carrier, and race organizers' own rules. Their terms apply to your use of them. Race names, logos and marks shown in HypeLap belong to their owners.

Ending your use

You can stop using HypeLap and delete your account at any time. We may suspend or end your access, remove content, or close watch links if you break these Terms or the Community Guidelines, if we must by law, or to protect people. Sections that by their nature should survive (such as content licenses for reports and safety, disclaimers, liability limits and governing law) will survive.

Disclaimers and liability

HypeLap is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not warrant that tracking, rankings or cheers will be accurate, uninterrupted or secure.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, or for injury, loss or damage arising from running, racing, a route, a race, other users or their content. Our total liability for any claim relating to HypeLap is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places do not allow some of these limits, so they may not apply to you. Nothing here limits liability that cannot be limited by law.

You agree to defend and indemnify us against claims arising from Your Content or your breach of these Terms, to the extent the law allows.

Governing law

These Terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Harris County, Texas, and you and we consent to that jurisdiction, except that you may bring a claim in the court of your home country if consumer law gives you that right. Apple-specific terms

If you use HypeLap on an Apple device, these also apply, and they control if they conflict with the rest of these Terms:

• These Terms are between you and us, not Apple. We, not Apple, are responsible for HypeLap and its content.
• Your license is limited to use on Apple-branded products you own or control, under the Usage Rules in the App Store Terms. Apple's Standard Licensed Application End User License Agreement also applies to the app.
• Apple has no obligation to provide maintenance or support for HypeLap. Support is provided by us at hello@hypelap.com.
• If HypeLap fails to meet an applicable warranty, you may tell Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation for HypeLap. Other claims, losses and costs are our responsibility to the extent the law requires.
• We, not Apple, are responsible for any claims about HypeLap, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims.
• You confirm you are not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Changes and contact
